Official Sweepstakes Rules
- No purchase is necessary to enter this sweepstakes, nor will it improve your odds of winning. Sweepstakes open only to legal residents of the United States and the District of Columbia at least 18 years of age. Do not enter the sweepstakes if you do not meet these requirements. By entering the sweepstakes, you are agreeing to be bound by these official sweepstakes rules.
- Sweepstakes begins at approximately 12:01am (eastern time) on March 1, 2008 and ends at 11:59pm (eastern time) on May 31, 2008.
- You can enter the sweepstakes by visiting http://www.giftescapes.com between the dates and times listed above. Fill out the sweepstakes entry form with all requested information and press the “Submit” button. Only one entry per person and only entries transmitted through the website will be accepted.
- GiftEscapes.com reserves the right to hold an entry invalid for any reason, including but not limited to the following:
a. Invalid e-mail address given.
b. Incomplete or invalid information given on entry form.
c. Failure to complete the entry form during the dates and times specified as beginning and end of sweepstakes.
- GiftEscapes.com, Gifts That Refresh, LLC, employees, managers and members are not responsible for any technical problems encountered when entering the sweepstakes or visiting the GiftEscapes.com website, including errors, failures, and delays in network transmission that may result in an invalid sweepstakes entry. Moreover, GiftEscapes.com and Gifts That Refresh, LLC, subsidiaries, employees, managers and members are not responsible for technical problems encountered when entering the sweepstakes or visiting the GiftEscapes.com website, including errors, failures, and delays in network transmission that may result in damages to entrants' computer hardware, software, Internet connection, or any other technological infrastructure.
- For a copy of the Official Rules of this sweepstakes, send a self-addressed, stamped envelope to GiftEscapes.Com, Official Sweepstakes Rules, P.O. Box 6339, Charlottesville, VA 22906 by May 31, 2008. Vermont residents need not include return postage.
- Employees, managers and members of GiftEscapes.com, Gifts That Refresh, LLC and subsidiaries, are not eligible to win. Members of the immediate family or household of the aforementioned persons are also ineligible.
- One grand prize winner will be selected on or about June 15, 2008 by way of a random drawing from among all valid entries received. This drawing, and any decisions made by any judges, will be final with respect to determining the winner of the sweepstakes. ODDS OF WINNING ARE BASED UPON NUMBER OF VALID ENTRIES RECEIVED. All winners will be notified by e-mail. GiftEscapes.com reserves the right to hold another drawing to choose a new winner in the event that the original winners do not respond to claim his/her prize within 10 days. Any such additional drawing will be governed by the same Official Rules.
- One grand prize winner will receive a GiftEscapes.com gift certificate valued at $100.00 (one hundred dollars). Approximate retail value of all prizes: $100.00.
- By submitting a sweepstakes entry, you agree to receive the GiftEscapes.com newsletter. You can opt-out of receiving the newsletter at anytime, however, by clicking on the link provided in the newsletter. Your decision to opt-out will not decrease your odds of winning.
- All taxes, fees, or other costs occasioned by Winner in association with the prize awarded will be the sole responsibility of Winner. Winner will release and hold harmless GiftEscapes.com and Gifts That Refresh, LLC, subsidiaries, employees, managers and members for any damages occasioned by Winner's use or misuse of the prize awarded. By entering the sweepstakes, Winner agrees that GiftEscapes.com has neither made nor is responsible for any warranties, in fact or in law, regarding the quality of the prize nor its fitness for any specific purpose. If the prize listed in the Official Rules becomes unavailable, GiftEscapes.com reserves the right to award a different prize of equal or greater value.
- Following a Winner being determined, said Winner will be required to sign and return an affidavit of eligibility and publicity release in order to claim the prize. Should Winner refuse to sign and return these documents within 7 days, a new winner may be chosen at the discretion of GiftEscapes.com. By accepting the prize, Winner will agree to the use of his/her name, likeness, voice or biographical information by GiftEscapes.com or any party authorized by GiftEscapes.com for advertising and promotional purposes without any additional compensation, except where prohibited by law.
- Any dispute or claim arising out of the use of the GiftEscapes.com website or the playing of this sweepstakes shall be governed by the laws of the State of Virginia, without respect to conflicts of laws principles. Any such claim shall be brought and maintained in the federal and state courts of the state of Virginia.
- If any of the Official Rules of this sweepstakes are held to be invalid by a court of competent jurisdiction, the remaining rules shall be unaffected by such ruling.
- GiftEscapes.com reserves the right to disqualify any sweepstakes entrant, or terminate the sweepstakes entirely as a result of any tampering, bug, technological difficulty, or computer virus that threatens the operations of the sweepstakes.
